PLEASE READ THESE TERMS CAREFULLY. BY USING THIS WEBSITE OR ORDERING PRODUCTS FROM IT, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET OUT BELOW.

These Terms of Service (the "Agreement") govern your use of www.lachicreations.com (the "Website"). Lachi offers products for purchase on this Website. This Agreement includes, and incorporates by reference, the policies and guidelines referred to below.

By using this Website, you also accept and agree to be bound by our Privacy Policy, Shipping Policy and Return & Refund Policy, each as amended from time to time.

ELIGIBILITY

You may shop as a guest or create an account. To create an account you must be competent to contract under the Indian Contract Act, 1872. Persons declared incompetent to contract under that Act are not eligible to hold an account.

A minor, being a person below 18 years of age, may use the Website and transact only through a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account and password, for restricting access to your account, and for all activity that occurs under your account. Lachi may terminate your account or refuse service if we discover that the person transacting is not competent to contract, or where we reasonably suspect fraud or misuse.

PRICING AND PRODUCT INFORMATION

All prices are listed in Indian Rupees and are inclusive of applicable GST.

We make every effort to display product colours, fabrics and measurements accurately. Slight variation between the image and the delivered product may occur due to screen settings and photography.

Lachi reserves the right to correct pricing errors and to modify or discontinue any product at any time without notice. If a pricing error affects your order, we will contact you before dispatch and offer you the choice of proceeding at the corrected price or cancelling for a full refund.

ORDER ACCEPTANCE

Your order constitutes an offer to purchase. Acceptance occurs when we dispatch the goods, not when the order is placed or payment is received.

We may decline or cancel any order, including for suspected fraud, incorrect pricing, unavailability of stock, or an undeliverable address. Where payment has already been taken, a full refund will be issued.

PAYMENT

We accept prepaid payment through our payment gateway, and Cash on Delivery where available.

Cash on Delivery orders may require confirmation by phone or WhatsApp before dispatch. We reserve the right to decline Cash on Delivery for any order, customer or delivery location, including where previous orders have been refused on delivery.

SHIPPING, RETURNS AND REFUNDS

Delivery, returns, exchanges, cancellations and refunds are governed by our Shipping Policy and our Return & Refund Policy, both of which form part of this Agreement.

USE OF THE WEBSITE

You agree not to:

• Use the Website for any unlawful purpose, or in breach of any applicable Indian law
• Attempt to gain unauthorised access to any part of the Website, its servers or any connected system
• Introduce any virus, malicious code or automated scraping tool
• Copy, reproduce or resell any part of the Website or its content without our written permission
• Impersonate any person, or misrepresent your affiliation with any person or entity
• Place orders using false details or a payment method you are not authorised to use

We may suspend or terminate your access to the Website for breach of these Terms.

The Website may contain links to third-party websites and use third-party services for payment, shipping, analytics and messaging. We are not responsible for the content, policies or practices of any third party. Your dealings with them are governed by their own terms.

DISCLAIMER OF WARRANTIES

The Website and its content are provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranty that the Website will be uninterrupted, error-free or free of harmful components. Nothing in this clause limits any right you have under the Consumer Protection Act, 2019 in respect of goods purchased from us.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Lachi's total liability arising out of or in connection with any order is limited to the value of that order.

We are not liable for indirect, incidental or consequential loss, including loss of profit, loss of opportunity or loss of data, arising from your use of the Website or from any delay in delivery caused by our courier partners, force majeure events, or circumstances outside our reasonable control.

INDEMNITY

You agree to indemnify and hold harmless Virsa Knits (India), its partners and employees against any claim, loss or expense arising out of your breach of this Agreement or your misuse of the Website.

FORCE MAJEURE

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, strikes, civil unrest, government restrictions, courier network failures or interruptions to internet or payment infrastructure.

GOVERNING LAW AND JURISDICTION

This Agreement is governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to this Agreement or your use of the Website is subject to the exclusive jurisdiction of the courts at Ludhiana, Punjab.
